There is no need to give a reason to get a divorce or dissolution - this is sometimes called ‘no fault’. However, you would need to be married or in your civil partnership for at least 1 year. If it’s been under 1 year you can find out how to separate from your partner.

You and your partner only need to make 1 application between you. You can send the application from:

both of you together - called a joint application
just you or your partner - called a sole application

The Government’s  Divorce, Dissolution and Sepa The Government’s  Divorce, Dissolution and Separation Act 2020, introduced no fault divorces in England and Wales. 

The new law means that instead of having to attribute blame to one party, a couple can mutually cite ‘irretrievable breakdown’ as the sole ground for wanting to obtain a divorce.

This can be done in by an individual or a joint statement. 

Either parties is now able to provide a statement saying their marriage has broken down without having to provide evidence about bad behaviour.

The divorce application can now be made online. There is no need  for the respondent to defend or to cross apply for a divorce.

Once the application is made, the applicant will have to wait until 20 weeks to apply for a conditional offer. 

This period allow both parties to reflect on their decision to divorce. 

Unless they are in the process of resolving financial dispute, the applicant can then apply for a divorce or dissolution final order after six weeks have elapsed from the date the conditional order was made.

Civil partnership : Couples wanting a civil partn Civil partnership :  Couples wanting a civil partnership, need to choose the kind of ceremony they want before giving notice, the ceremony must be held within 12 months of ‘giving notice’. ‘Giving notice’ means the couple signs a legal statement at the local register office saying they intent to get married or form a civil partnership as well as the final venue for the ceremony. 

Cohabitation :  Any two individuals, including same sex couples, who are intending to live together (cohabitate) should consider the legal ramifications beforehand. Since by living together they don’t naturally acquire legal rights such as ‘common-law wife’. However, the issues from a relationship breakdown such as maintenance and financial settlement are more precarious as the law does not provide the same legal remedies.
