Limitation Periods
There are several limitations periods in bringing an action against a party; if a limitation period is passed the defendant will have defence of limitation. Below are some key limitation periods
1- Breach of Contract and certain actions in tort- 6 years
2- A claim against an employer for example for constructive dismissal – 3 months less one day
3- Actions on a speciality, such as a deed – 12 years
4- Personal injury or death – 3 years
5- Defamation – 1 year
6- Actions under Consumer Protection Act – 3 years
7- Action to recover rent – 6 years
8- Action for fraudulent breach of trust – unlimited
9- Action to enforce judgment – 6 years
10 – Judicial Review – promptly and within 3 months
