Post -Nuptial/Pre-Nuptial agreements
Nuptial agreements, whether entered into before marriage or post-marriage are not legally binding! However, they can be given weight during financial proceedings if they meet certain conditions such as:
1- legal advice taken by the parties about the contents and implications of a nuptial agreement
2- fairness of its terms
3- time of the agreement
4- whether the parties entered into the agreement freely or not
Accordingly, parties will have to be open and transparent about their financial circumstances during the process of reaching a nuptial agreement.
Whilst the process can be costly, it may be an option if you want to have financial clarity and transparency in your marriage specially if you have assets that you wish to protect for example for a child from a previous relationship.
